Ojop Sweden AB Limited Lifetime Warranty
At Ojop Sweden AB, we stand behind the superior quality and durability of our products. Our hot drop forged toggle latches are engineered to perform under demanding conditions and this warranty reflects our confidence in their materials and craftsmanship.
1. Warranty Coverage
Ojop Sweden AB (later “Ojop”) warrants its hot drop forged toggle latches to be free from defects in material and workmanship for the lifetime of the product.
2. Definition of “Lifetime”
For the purpose of this warranty, “Lifetime” is defined as the normal and expected service life of the product when used for its intended purpose under normal operating conditions. This warranty is contingent upon the proper installation use and maintenance of the product.
3. Warranty Exclusions
This limited lifetime warranty is comprehensive but does not cover damage or failure under the following conditions:
- Normal Wear and Tear: Gradual degradation of performance and cosmetic issues such as scratches, dents, or changes in finish that occur with regular use over time.
- Improper Installation: Damage or failure resulting from improper installation, including but not limited to incorrect welding, misalignment, or any modification to the latch from its original state.
- Misuse, Abuse or Negligence: Damage or failure caused by misuse, abuse, negligence, accident or application beyond the product’s specified design and load capacity.
- Environmental Damage and Corrosion: Corrosion or damage resulting from environmental exposure. The performance of surface finishes (e.g., zinc plating) is not covered by this warranty as it is subject to environmental conditions beyond our control. For applications requiring high corrosion resistance, we recommend our stainless steel drop forged latch options.
- Consequential or Incidental Damages: This warranty is strictly limited to the repair or replacement of the defective toggle latch itself. Ojop is not liable for any indirect, incidental or consequential damages, including but not limited to damage to property, loss of time, loss of profit, loss of use or personal injury.
4. Covered Parties
This limited lifetime warranty is extended exclusively to the original business-to-business (B2B) purchaser of the product directly from Ojop or its authorised distributors. This warranty is non-transferable.
5. Exclusive Remedy
Upon verification of a valid warranty claim, Ojop’s sole obligation will be, at its discretion, to (a) repair the defective product, (b) replace the defective product with a new or functionally equivalent product or (c) issue a credit to the purchaser’s account for the original purchase price of the product. The purchaser is responsible for all costs associated with shipping the product to Ojop or its designated representative for warranty evaluation.
6. Warranty Claim Procedure
To initiate a warranty claim, the original purchaser must contact the Ojop sales representative or authorized distributor (seller from whom the product was originally purchased). The claim must include a clear description of the alleged defect, photographic or video evidence and proof of purchase (such as an invoice number or order confirmation).
7. Governing Law and Jurisdiction
This warranty and any disputes arising from it shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. The exclusive jurisdiction for any legal action arising from this warranty shall be the courts of Sweden.
Ojop Sweden AB reserves the right to modify or update this warranty policy at any time without prior notice. The warranty in effect at the time of the original product purchase will be the one that applies.
